Second DWI Dismissed in Charlotte after Test Refusal

On behalf of Randall & Stump, PLLC in on Tuesday, October 8, 2019

A man recently came to us after he was charged with his second DWI in three years. While he refused the initial breath test, this refusal subjected him to an automatic 12-month license suspension, and after a warrant was issued for his blood, he was still charged and exposed to up to 24 months in jail and a four-year license suspension if convicted. This was a serious situation for our client, but after negotiating with the prosecution we secured a complete dismissal of the DWI. Once he completes the mandatory suspension for the refusal, he can restore his license with no additional consequences.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
