No Disciplinary Action Taken by the NC Nursing Board

Our client was initially accused of violating HIPAA by disclosing images of injuries of an ER patient to her co-workers and friends. But there was absolutely no evidence to substantiate the charges. We investigated, submitted a defense packet to the nursing board, and requested an in-person interview. As a result, the board took no disciplinary action.

In another case, our client was accused of falsifying medical records after allegedly failing to document that she fed a baby incorrectly. Another charge was added later by the NC nursing board and alleged she exceeded her scope of duty in giving a baby a bottle instead of an IV feeding.

Subsequently, we showed neither had merit because our client had told the oncoming nurse how she fed the baby and was permitted to use her discretion to bottle feed after going through the proper feeding guidelines. Once we submitted our defense packet and the client had an in-person interview, the board decided no disciplinary action was necessary.
