DWI Dismissed – Preserving Immigration Status

Our client was a legal immigrant farmworker, who doesn’t speak English as a first language. One day after work he was pulled over for failing to maintain his lane. The officer approached the car, and asked if everything was okay, to which our client replies he was tired because he “just killed a cow.”

Given the odd answer, the officer believed our client was drunk and started an investigation. He quickly realized the language barrier made that impossible. However, he decided the statement and an alleged odor was enough to charge him with DWI. When we got to court, the officer’s notes were a mess and undercut his credibility. Between that and clearing up the matter of killing a cow – our client had just helped slaughter and butcher a cow at the farm – the charges were dismissed.

Our client avoided any collateral consequences to the renewal of his immigration status as well.
