DWI Charges Dismissed Before Trial

Our client was charged with Driving While Impaired after being involved in a multi-car accident. As a result of the accident and observations at the scene, a DWI investigation was initiated. The client performed poorly on SFSTs and blew over the legal limit. The client faced active time in jail and a 12-month revocation of their license. We were able to obtain a dismissal of all charges without having to proceed to trial.

DWI, Open Container, & Failure to Reduce Speed Dismissed

Our client was found in the middle of the street after allegedly hitting two parked cars and flipping her vehicle. She was charged with DWI, having an open container, and speeding. We discovered that there were issues with the blood draw at the hospital. In addition, the charging documents and officers’ notes went missing. After a handful of court appearances, the prosecutor agreed to drop the charges.

DWI & Hit and Run Dismissed Despite High BAC

Recently, we were able to get DWI and hit and run charges dismissed for a woman involved in a car accident, who failed field sobriety tests and tested at a .15 BAC. Due to the high BAC, our client faced jail time, and, if awarded driving privileges at all, she’d need to have an interlock device installed. Fortunately, there was nothing but property damage, and after a handful of court hearings we secured dismissal of all charges.

COMMON QUESTIONS ABOUT CHARLOTTE, NC DWI CHARGES

What happens after a DWI arrest in North Carolina?

You’ll likely be booked, held briefly, and given a court date. The DMV may also begin the civil process to suspend your license, even before you’re convicted.

Will I lose my license after a DWI?

Possibly. Your license can be suspended automatically after a DWI arrest or refusal, but we can request a DMV hearing and fight to keep or restore your driving privileges.

What’s the difference between a DWI and DUI in NC?

In North Carolina, DWI (Driving While Impaired) is the official legal term—there’s no separate DUI charge. It covers impairment from alcohol, drugs, or both.

How much does a DWI lawyer in Charlotte cost?

Costs vary by case, but we offer consultations so you can understand your options and make an informed decision. We’ll explain fees clearly before moving forward.

What are the penalties for a second or third DWI offense?

Repeat offenses can lead to longer license suspensions, hefty fines, ignition interlock requirements, and mandatory jail time. We work to reduce or avoid these penalties whenever possible.

Is jail mandatory for a DWI conviction?

Not always. First-time offenders in Charlotte can often avoid jail with the right defense strategy, especially if we intervene early and negotiate alternative sentencing.

What happens if I refuse a breath test?

Refusing a chemical test in North Carolina triggers a one-year license suspension, even if you’re not convicted of DWI. However, we may be able to challenge the refusal and minimize the fallout.
