Protective Order Lifted for Man Accused of Domestic Violence

On behalf of Randall & Stump, PLLC in on Tuesday, October 8, 2019

Our client was a physical therapist and veteran, who was accused of domestic violence. The man’s ex-wife filed a 50B protective order against him, based on various and very damaging accusations. Living with a protective order against him would be detrimental to his line of work and professional license, not to mention, his reputation, so we diligently worked to uncover the facts. It became clear that the allegations in the order were largely fabricated and only filed in an effort to gain leverage in a custody dispute.

We appeared at a hearing and after highlighting the flaws, the order was not extended because she could not demonstrate that domestic violence actually occurred. This spared him the hassle of living with protective order over his head and the potential consequences, both criminally and before his professional licensing board.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
