Our client was charged with DWI, Felony Possession of Marijuana, and Felony Possession of Methamphetamine. The potential sentence was 36 months in prison. She was stopped in the parking lot of a gas station in her vehicle. There was an open bottle of liquor in the front seat. Officers had her perform field sobriety tests and searched her vehicle. The officers allegedly found marijuana in the trunk of her car and a significant amount of methamphetamine in her center console.
The case went to jury trial. The prosecutor dismissed the marijuana charge at the end of State’s evidence. At the end of the trial, our client was acquitted of the methamphetamine charge, but was found guilty of driving while impaired. She was sentenced to probation.
