Multiple Larceny Charges Dismissed Before Indictment

On behalf of Randall & Stump, PLLC in on Thursday, July 30, 2020

Our client was the shop manager at a supply company that also did repairs. He was accused along with a co-worker of stealing copper wire from the business and faced charges of larceny and conspiracy to commit larceny, exposing him to 2-4 years in prison.

The accused co-worker, who had a long criminal record was seen on video stealing the r wire. To help himself, he pulled our client into it and made the story plausible by pointing to an interaction caught on tape where the two divided some money. But that money was not the proceeds from stolen goods, instead, it was earnings from a piece of equipment that the employer gave our client and the co-worker helped him sell.

Because of his felony record, and the actions of the co-defendant to implicate our client, we knew the case would be tough. We gathered bank statements and travel records to show that our client was not part of the copper wire thefts. In fact, he and his family were on vacation when one occurred.

We relentlessly negotiated with the prosecutors to drop the charges in light of this evidence and prevailed. All charges were dismissed before our client was indicted so the matter never reached Superior Court.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
