Multiple Gun Charges Dismissed for Felon after a Shootout

On behalf of Randall & Stump, PLLC in on Friday, March 27, 2020

Our client was involved in an altercation with some associates in a local club that spilled into the parking lot and continued when he arrived at his apartment complex. Apparently, one of the individuals involved got out of a car with a gun. This caused others in our client’s car to get out with their firearms. Everyone started taking shots at each other, but fortunately, no one was hit.

In the chaos, our client took off into the apartment complex. Eventually, the police arrived and since our client was the only one with a felony record, he was charged with discharging a firearm in an occupied property, possession of a firearm by a felon, and discharging a gun within the city limits. In total, he was facing 94 months in prison.

We reviewed the security footage of the incident, which only showed muzzle flashed and some general commotion. Without any definitive evidence, no gun recovered, and other inconsistencies, we negotiated to have all the gun charges dismissed.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
