Fake ID & Aiding the Consumption of Alcohol Charges Dismissed

Our client’s niece used a fake ID to consume alcohol at a bar and was caught. As an adult with her, our client was charged with aiding and abetting possession/consumption of alcohol by a person under 21. That’s a class one misdemeanor punishable by up to 120 days in jail so this was a serious matter.

The charges resulted after our client and niece went to a concert. The niece had been visiting the client for a few days and they had previously visited bars and restaurants where the niece produced ID and drank alcohol without incident. She was carded and admitted into the VIP section, was carded again by the waitress, and was then served alcohol. Another employee then requested the ID, which the niece produced, only to be run through the system and found to be fake.

The prosecutor agreed to drop the charges after we explained our client didn’t know the niece wasn’t of age. She was estranged from her sister and didn’t think to ask her niece’s age. Additionally, she had seen her produce ID successfully several times, so it didn’t occur to our client that the ID was fake.
