DUI/DWI – I blew a high number, should I fight the case

On behalf of Randall & Stump, PLLC in Charlotte, Criminal Defense, DUI/DWI, North Carolina on Monday, March 14, 2016

We get a large number of DUI/DWI calls where the individual states they blew a high number (typically over .15) and they always ask if it is worth hiring a criminal lawyer to fight the case.  The short answer is ABSOLUTELY!!  The long answers depends on the facts related to your case.

While you may feel like the odds are stacked against you because of the higher BAC in your DUI/DWI case, that does not mean there are not avenues to explore, which could ultimately result in having your case dismissed or even obtaining a not guilty verdict.  At Randall & Stump, we thoroughly examine the facts of your case from the moment the cop laid eyes on your vehicle until the time you were booked at the police station.  Typical questions to answer are: 1) did the officer have a legitimate reason to stop your car, 2) did the officer administer the field sobriety tests correctly, 3) did the officer record his observations correctly, 4) does any video or audio of the stop match the officer’s notes/testimony, 5) did the officer have probably cause to arrest you for the charge of DWI, and 6) was the breath test machine working properly and are the maintenance records current.

While the answers to these questions vary on a case-by-case basis, the experienced DWI attorneys at Randall & Stump are more than happy to discuss your case with you to give you an idea of the strengths and weaknesses, despite how bad you may feel about the likelihood of success in your case.
