We get a large number of DUI/DWI calls where the individual states they blew a high number (typically over .15) and they always ask if it is worth hiring a criminal lawyer to fight the case. The short answer is ABSOLUTELY!! The long answers depends on the facts related to your case.
While you may feel like the odds are stacked against you because of the higher BAC in your DUI/DWI case, that does not mean there are not avenues to explore, which could ultimately result in having your case dismissed or even obtaining a not guilty verdict. Typical questions to answer are: 1) did the officer have a legitimate reason to stop your car, 2) did the officer administer the field sobriety tests correctly, 3) did the officer record his observations correctly, 4) does any video or audio of the stop match the officer’s notes/testimony, 5) did the officer have probably cause to arrest you for the charge of DWI, and 6) was the breath test machine working properly and are the maintenance records current.
